Contentko respects intellectual-property rights and complies with the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512. This Policy explains how rights holders can submit takedown notices and how users can submit counter-notices.

Submitting a Takedown Notice (§512(c)(3))

To be effective under the DMCA, your notice must include all of the following:

1. A physical or electronic signature of the copyright owner (or person authorized to act on their behalf);
2. Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works);
3. Identification of the material claimed to be infringing — provide the URL on Contentko, or enough detail for us to locate it;
4. Your contact information — name, mailing address, telephone, email;
5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
6. A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the owner of the right being infringed.

Misrepresentations in a takedown notice are sanctionable under 17 U.S.C. §512(f) — the submitter is liable for damages and attorneys' fees of any party injured by a knowingly false claim.

Counter-Notice (§512(g))

If your content was removed and you believe the removal was in error or by misidentification, you may submit a counter-notice including:

1. Your physical or electronic signature;
2. Identification of the material that was removed and the location at which it appeared before removal;
3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed by mistake or misidentification;
4. Your name, address, telephone, email;
5. A statement consenting to the jurisdiction of the U.S. District Court for the District of Wyoming (or, if outside the U.S., any judicial district in which Contentko may be found) and acceptance of service of process from the original complainant.

Send to [email protected] with subject DMCA — Counter-Notice. We will forward the counter-notice to the original complainant. If they do not file an action seeking a court order against you within 10–14 business days, we will (in our sole discretion) restore the removed material.

Repeat-Infringer Policy

Contentko terminates the accounts of users we identify as repeat infringers, in compliance with §512(i). A "repeat infringer" is a user against whom we have received three (3) substantively complete takedown notices within any 12-month period, or fewer where the conduct is egregious.

Trademark, right of publicity, defamation

This Policy covers copyright. For trademark or right-of-publicity concerns, contact [email protected] with subject Trademark Concern or Right of Publicity. We evaluate these reports under our Acceptable Use Policy on a case-by-case basis; we are not obligated to remove content based on a non-DMCA notice.

Limitation

This Policy does not waive any defense available to Contentko or BCAX LLC, including any defense under §512, §230 (Communications Decency Act), or applicable common law.

Governing Law & Jurisdiction

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. The exclusive forum for any dispute shall be the state and federal courts located in Sheridan County, Wyoming, except where applicable consumer-protection law of your country of residence grants you a non-waivable right to a local forum.
